Please read these Terms and Conditions ("Terms") carefully before using the Mothering Together application and website located at app.motheringtogether.space (the "Service"), operated by Kristina Olsen Design LLC ("we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

1. About the Service

Mothering Together is a consumer postpartum support application that provides informational guidance, emotional support, and recovery resources to mothers during the first year after birth. The Service is powered in part by an AI companion named Elle.

The Service is currently in early access. Features are actively being developed and the product may change, expand, or be temporarily unavailable during this period.

2. Not Medical Advice

Nothing in the Service should be construed as a substitute for professional medical advice from a qualified healthcare provider. Always consult your doctor, midwife, or other qualified health professional with questions about your health or medical condition.

If you are experiencing a medical emergency, call emergency services (911) immediately. Do not delay seeking emergency care because of information provided by the Service.

3. Eligibility

You must be at least 18 years of age to use the Service. By using the Service, you represent that you meet this requirement. The Service is designed for use by postpartum mothers and is intended for a general consumer audience.

4. No Account Required

The current version of the Service does not require account registration. You may access the Service directly. Any information you enter — including conversations with Elle, mood reflections, and recovery entries — is stored locally on your device only and is not accessible to us.

Because we do not maintain accounts at this time, we are unable to recover locally stored data on your behalf if it is lost or deleted.

5. Waitlist

You may voluntarily join our waitlist by providing your email address. By doing so, you consent to receive product updates and communications from Mothering Together. You may unsubscribe at any time. Joining the waitlist does not guarantee access to any specific feature or version of the Service.

6. Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:

• Use the Service in any way that could harm, disable, or impair the Service or its availability to others
• Attempt to gain unauthorized access to any part of the Service or its underlying systems
• Use automated means (bots, scrapers, crawlers) to access or collect data from the Service
• Use the Service to harass, threaten, or harm any person
• Attempt to reverse engineer, decompile, or extract the source code of the Service
• Use the Service for commercial purposes without our prior written consent

7. AI-Generated Content and Limitations

The Service uses artificial intelligence to generate responses through Elle. You acknowledge that:

• AI-generated responses may contain errors, inaccuracies, or omissions
• Elle's responses are informational in nature and are not a substitute for professional medical judgment
• The AI model may not always correctly interpret symptoms, situations, or emotional states
• Content labeled as "AI-generated" has not been reviewed by a licensed healthcare provider
• Content labeled as "expert-reviewed" has been reviewed by qualified professionals but is general in nature and not tailored to your specific medical situation

We work to ensure that Elle provides safe, accurate, and supportive responses, but we cannot guarantee the accuracy or completeness of AI-generated content.

8. Crisis and Safety Resources

The Service includes access to crisis and safety resources. If you are experiencing thoughts of self-harm or suicide, please contact:

9. Intellectual Property

All content, features, and functionality of the Service — including text, graphics, logos, software, and the Elle AI system — are owned by Kristina Olsen Design LLC or its licensors and are protected by applicable intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to access and use the Service for your personal, non-commercial use. You may not reproduce, distribute, modify, or create derivative works from any part of the Service without our prior written consent.

10. Local Data

Any content you enter into the Service is stored locally on your device. You retain full ownership of and responsibility for that content. Because we do not have access to locally stored data, we cannot be held responsible for its loss, corruption, or unauthorized access by others with access to your device.

11. Privacy

Your use of the Service is also governed by our Privacy Policy. By using the Service, you consent to the collection and use of your information as described in the Privacy Policy.

12. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

• WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT
• WARRANTIES THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE
• WARRANTIES AS TO THE ACCURACY, COMPLETENESS, OR RELIABILITY OF ANY CONTENT

The Service is in active development. Features may be added, removed, or changed without notice.

13. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, KRISTINA OLSEN DESIGN LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE, INCLUDING BUT NOT LIMITED TO:

• Loss of locally stored data
• Personal injury or health outcomes
• Reliance on AI-generated content

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM THESE TERMS OR YOUR USE OF THE SERVICE SHALL NOT EXCEED $100.

14. Indemnification

You agree to defend, indemnify, and hold harmless Kristina Olsen Design LLC and its officers, directors, employees, and agents from and against any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising from your use of the Service or your violation of these Terms.

15. Modifications to the Service and Terms

We reserve the right to modify or discontinue the Service at any time. We may update these Terms as the product evolves — particularly as account registration and server-side storage are introduced. Material changes will be communicated by email or through the Service. Continued use after changes take effect constitutes acceptance of the updated Terms.

16. Governing Law

These Terms are governed by the laws of the State of Michigan, without regard to conflict of law principles. Any disputes shall be subject to the exclusive jurisdiction of the state and federal courts located in Michigan.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding your use of the Service.
